Regulatory Status of ATLAS RE CAPITAL
ATLAS RE CAPITAL S.C.A., SICAV-RAIF, is a Reserved Alternative Investment Fund (RAIF) established under the Luxembourg law of 23 July 2016.
The Fund:
- is not subject to prior approval by the CSSF,
- but is indirectly supervised via its AIFM, authorized under the AIFM Directive 2011/61/EU,
- can only be offered to professional/qualified investors in accordance with applicable legal provisions.
Eligible Investors
Access to the Fund is limited to:
- institutional investors,
- professional investors as defined by MiFID II,
- qualified investors confirming their status in writing and investing at least EUR 125,000,
- or holding a certificate issued by an authorized financial institution.
The Fund is not open to the public.
Detailed documents are only accessible after verification of investor status.
Geographical Restrictions
The Fund’s shares:
- are not registered under the U.S. Securities Act of 1933,
- may not be offered or sold to U.S. Persons,
- may not be distributed in any jurisdiction where their marketing would violate local law.
It is the responsibility of each potential investor to ensure they are authorized to access the Fund under their national regulations.
SFDR Classification
ATLAS RE CAPITAL is classified as Article 8 under Regulation (EU) 2019/2088 (SFDR).
The Fund:
- promotes environmental and social characteristics,
- does not have the objective of sustainable investment as defined under Article 9,
- publishes its PAI (Principal Adverse Impacts) in accordance with regulatory requirements.
